Age of Conan Open Beta Contest

Official Contest Rules

1. DESCRIPTION : The “Age of Conan Open Beta Contest” ("Contest") is an open beta, skill-based online Contest which will be played through the Age of Conan beta offered by FilePlanet. The sponsor of the Contest is FilePlanet.com (“Sponsor”). The Cosponsor of the Contest is Funcom Sales GmBH. (“Cosponsor”). The administrator of the Contest is Creative Zing Promotion Group (“Administrator”).

• The Contest play period ("Contest Period") will begin on Thursday, May 1, 2008 at 9:00 am Pacific Time (“PT”) and end on Sunday, May 11, 2008 at 9:00 am PT.
• The official time for the Contest Period shall be kept by IGN Entertainment, Inc.’s clock.
• This Contest is classified as a two (2) class “leveling” combo contest
• Entrants do not play against each other; they play against a the clock
• The Entrant who levels two (2) class types to the maximum level 13 in the LEAST amount of time will be declared a potential winner, pending verification.
• The total playtime for leveling both classes will be combined to determine the overall speed.
• A total of nine (9) prize packages will be awarded to the nine (9) eligible entrants who have leveled two (2) classes according to the combo types below.
• In the event of a tie, the tied Entrants will be given one (1) additional character to level, as determined by the Sponsors. The Entrant who levels the character in the least amount of time for the tie-breaker round will be declared the winner.
• Class Combo types:
• Herald of Xotli + Assasin
• Herald of Xotli + Conqueror
• Herald of Xotli + Dark Templar
• Barbarian + Tempest of Set
• Barbarian + Ranger
• Barbarian + Necromancer
• Guardian + Bear Shaman
• Guardian + Priest of Mitra
• Guardian + Demonologist

 2. ELIGIBILITY: CONTEST IS VOID IN VERMONT, IOWA, NEW JERSEY, AND MARYLAND Contest is open to legal residents of the United States, with the exception of residents of the states of Vermont, Iowa, New Jersey, and Maryland, who meet each of the following criteria (“Entrant”):

• Are at least 17 years of age at time of entry;
• Have an active and valid File Planet account;
• Own or have access to an Internet-enabled console as of April 30, 2008 through the end of the Contest Period

Note: Eligible entrants who are under the legal age of minority in their state of residence (“M inor”) should get their parent or legal guardian’s permission to enter.  A Minor entrant will be required to prove parental consent in the form of an Affidavit of Liability before he or she can be declared a winner and any prize can be awarded.

This Contest is not intended to solicit purchase of any materials required for play. Any individuals (including but not limited to employees, producers, directors, consultants, independent contractors and interns) who have, within the past six months, held employment with or performed services for Sponsor, Cosponsor, Contest Administrator, Eidos (collectively, "Contest Entities") or any organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Contest are not eligible to enter or win. Immediate family and household members of such individuals are also not eligible to enter or win. "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. "Household Members" shall mean those people who share the same residence at least three months a year. Void in and to residents of Vermont and Maryland, Iowa, New Jersey, and where prohibited.

 3. CONTEST ENTRY: To enter:

• Sign up for the beta at http://www.fileplanet.com/promotions/ageofconan/beta/.
• Follow the on-screen instructions to completely and accurately provide all of the information and materials required for entry.
• Entries will not be complete until Entrant has followed the onscreen prompts to download and install the game.
• Go to betaregister.ageofconan.com on the Funcom Age of Conan site, register your key and create and account.
• Launch the game and create your characters.
• Entrants can create two (2) or more characters, from the chart as detailed below.
• Entrants must “level” the respective characters according to the Class Combo types in Section 1 of the rules.

Incomplete or unintelligible entries will be disqualified. All information provided by Entrant becomes the property of Sponsor. Limit one (1) entry per person for the duration of the Contest Period. ELIGIBLE ENTRANTS MUST SUBMIT IN ACCORDANCE WITH THESE OFFICIAL RULES. NO OTHER METHOD OF SUBMISSION WILL BE ACCEPTED.

The Contest Entities, in their sole and unfettered discretion, may reject or disqualify any Entrant at any time (whether before or after game play has commenced or any winners have been determined) if the Contest Entities believe that such Entrant does not meet the eligibility criteria, has violated the rules of prior contests, has violated these Official Contest Rules, engages in inappropriate, disruptive, or abusive conduct or behavior, or otherwise is not appropriate for the Contest. In addition to these Official Contest Rules, Entrants are also subject to modifications or clarifications to these Official Rules as posted by the Contest Entities from time to time on the Contest Website. Contest Entities will not provide customer service for any issue related to Game software. Each Entrant must be the rightful owner of the FilePlanet account used for game play. In the event of a dispute as to the identity of a winner, the winner will be deemed to be the person in whose name the FilePlanet account was opened. Entrants are expressly forbidden from using multiple FilePlanet accounts to participate in the Contest. Any Entrant suspected or discovered to have used or be using multiple accounts in the course of the Contest may be immediately disqualified and/or have such accounts terminated. By entering the Contest each Entrant acknowledges and agrees that Contest Entities shall have the right to access and use such Entrant's account information (and any personal information associated therewith) if Contest Entities reasonably believe that such Entrant has competed using multiple accounts.

4. PRIZES (9 Total): Each winner will be selected to receive a Grand Prize package consisting of the following: A.) One (1) Signed Collector's Edition of Age of Conan and lifetime Conan Account, Approximate Retail Value (“ARV”): $ 300.00; B.) One (1) Official Age of Conan Gaming Headset, Inspire T6100 5.1 speaker set and Sound Blaster X-Fi XtremeGamer sound card, ARV: $299.99; C.) One (1) Direct2Drive Gift Certificate and Annual Founder's Club Subscription, ARV: $109.95; D.) One (1) Age of Conan Keyboard, inlay and mouse mat, ARV: $84.99; E.) In-Game Virtual Items package (Rhino, Mammoth, Ring of Acheron, Drinking Cape, Amazon Bow), ARV: $ 75.00. Total Prize ARV: $869.93. Total value of promotion is $7829.37. Any difference between the estimated retail value of any prize and the actual value will not be awarded. Winner will be responsible for any and all federal, state and/or local taxes resulting from acceptance of the prize. Prize winner cannot assign or transfer the prize to another person. No cash or prize substitution is allowed except at the discretion of Contest Entities. If a prize cannot be awarded due to circumstances beyond the control of the Sponsor or Contest Administrator, a substitute prize of equal or greater retail value will be awarded; provided, however, that if prizes are awarded but unclaimed/forfeited by recipient, prize may not be re-awarded, in Contest Administrator’s sole discretion. Other restrictions may apply.

5. WINNER SELECTION AND NOTIFICATION: The nine (9) entrants with the least amount of playtime to level the two (2) class combo will be declared potential winners, pending eligibility verification. In the event that a potential winner is a minor, all communication will be directed to the parent or legal guardian of such Entrant. Potential winners will be notified via email at the email address listed in their Contest entry on or about May 23, 2008. Selected winners will be required to respond (as directed) to the notification within 72 hours of attempted notification. The failure to respond timely to the notification may result in forfeiture of the prize. Winners may be required to verify eligibility and to execute before a notary public and return within ten (10) days an affidavit of eligibility and liability/publicity release covering eligibility, liability, advertising, publicity and media appearance issues, unless prohibited by law. Prizes will not be awarded until all such properly executed and notarized forms are returned.

6. CONDITIONS OF PARTICIPATION/RELEASES : Contest is void where prohibited or restricted by law. All federal, state and local laws and regulations apply. By participating, Entrants agree to be bound by these official rules and the decisions of the Contest Entities, which shall be final in all respects. By participating in this Contest and/or by accepting any prize that they may win, Entrants agree to release the Contest Entities, each of their respective parent, subsidiary and affiliated companies, units and divisions and advertising and promotional agencies and prize suppliers; and each of their respective officers, directors, agents, shareholders, representatives and employees; and each of these companies and individuals' respective successors, representatives, assigns and parent and affiliated companies (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Contest and/or acceptance or use of the prize. Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. Contest Entities are not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Contest Entities sole discretion, without further obligation or compensation. The Released Parties shall not be liable for: (i) late, lost, delayed, stolen, misdirected, postage-due, incomplete unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Contest; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Contest. Contest Entities disclaim any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest, and reserves the right, in its sole discretion, to cancel, modify, reset or suspend the Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond Contest Entities’ control, corrupt or adversely affect the administration, security or proper play of the Contest, including, without limitation, insufficient volume of eligible Entrants. Contest Entities may prohibit you from participating in the Contest or winning a prize if, in its sole discretion, it determines you are attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other Entrants or Contest Entities’ representatives. This Contest will be governed by the internal laws of the State of California. Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction within the State of California and you hereby submit to jurisdiction in California. Any and all disputes, claims, and causes of action arising out of or in connection with this Contest, shall be resolved individually, without resort to any form of class action and Entrants waive any right to act in a representative capacity on behalf of the general public or other persons similarly situated. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THE CONTEST. ENTRANTS HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

7. PRIVACY POLICY: Any personal information supplied by you to Contest Entities will be subject to their privacy policies posted at http://corp.ign.com/privacy.htm and http://community.ageofconan.com/wsp/conan/frontend.cgi?func=publish.show&table=CONTENT&func_id=1723&selected=0. By entering the Contest, you grant Sponsors permission to share your email address and any other personally identifiable information with the Contest Administrator for purposes of verification and prize fulfillment.
